ДЕРЖАВНО-ПРИВАТНЕ ПАРТНЕРТВО У СФЕРІ ОБОРОНИ

Abstract

The article analyzes the general state of public-private partnership in Ukraine during the countermeasures against russian aggression. It was established that the mechanisms of interaction between the state and the private sector in the sphere of ensuring national security have not been implemented by the legislation of Ukraine to this day. At the legislative level, there is no provision for public-private partnership in the field of defense.

This will make it possible to increase the efficiency of the defense-industrial complex and attract investments. Such a law would regulate the organizational and legal principles of the interaction of the state partner with private partners within the framework of the implementation of public-private partnership in the field of defense, principles, objects and forms of implementation, features of production (modernization) and disposal of weapons and military equipment, analysis of the implementation of the effectiveness of state − private partnership in the field of defense of Ukraine, state control and many other unresolved issues.

The public-private partnership between the state and private business is significantly different from the relationship under an ordinary contract. Public-private partnership is based on the use, exchange and combination of non-monetized resources of two partners − the state and a private entrepreneur. It is proposed to implement partnership and build trust between the state and the private sector by attracting private investments, joint financing and implementation of projects, conclusion of forward contracts, creation of sponsored units of the Ministry of Defense.
