The article analyzes the existing regulatory and legal framework for the protection of intellectual property rights, the procedure for paying compensation to the authors of intellectual property rights and technologies during R&D on armaments development and modernization, examines the legal basis for compensation to authors, existing intellectual property protection instruments, existing forms of legal protection of design documentation and other results of R&D, including for development and modernization of weapons and military equipment, as well as options for exercising property rights, which determine the procedure for paying compensation to authors.
The article highlights problematic issues related to gaps in the legislation, provides proposals for its possible improvement, and emphasizes some aspects of regulation of intellectual property rights during the war.
The current realities of managing the portfolio of intellectual power for the minds of the military camp, possible blackouts, and the short-circuiting of lines for carrying out actions related to the protection of the rights of intellectual power are examined. information about the procedures for obtaining these rights on objects of intellectual power, as well as options for accessing possible problems with potential judicial rights.
The author also considers the problematic issues that prevent the payment of compensation to the authors of such objects created during the development of weapons and military equipment.
